This course will identify the most recent developments in Whistleblowing regulation, enforcement activities around confidentiality issues, the pursuit (or lack thereof) of retaliation claims by the SEC and legal developments since 2018. 

Learning Objectives:

The session will highlight the following topics:

  • Evaluate what is happening with Whistleblower Reward with the SEC and CFTC
  • Identify where the government stands with respect to enforcement activities around confidentiality issues
  • Determine whether or not confidentiality still a hot button for the government
  • Measure the degree to which the SEC will pursue retaliation claims
  • Discuss whether last year’s Digital Realty case has impacted employee behavior
  • Examine case updates
  • Define the most recent legal developments to include: 
    • When can whistleblowers make claims against non-publicly traded companies
    • Discuss the whistleblower claims by lawyers and compliance personnel
    • Analyze the status of internal complaints v complaints to SEC and determine what is protected
    • Determine whether whistleblower claims can be arbitrated
