Description

This session will address developments in DOJ and SEC enforcement of the US Foreign Corrupt Practices Act.  Over the past year, DOJ and SEC have continued vigorously to enforce the FCPA and are deploying extensive resources toward that end.  The session will address recent settlements reached by financial institutions and corporates, recent charges announced by DOJ against individuals, recent sentences imposed on individuals for FCPA violations, court decisions involving prosecution of individuals by DOJ and/or SEC (including the recent dismissal on statute of limitations grounds of an SEC action against two individuals), decisions pending in US courts involving interpretation of the territorial reach of the FCPA, the DOJ’s recently-announced policy of seeking to avoiding “piling on” of penalties in corporate settlements across US agencies and between US and non-US enforcement authorities, the extent of cross-border cooperation amongst enforcement authorities, as well as the DOJ’s recent public statements seeking to encourage self-disclosure by companies that detect FCPA issues in recently-acquired companies.
