This session will educate the student on the basic rules of fiduciary responsibility under ERISA.  We will focus on who is a fiduciary under ERISA, the primary duties of fiduciaries and the actions fiduciaries should and should not take in order to effectuate those duties.  This session will discuss who is a party in interest to an ERISA covered plan, prohibited transactions and the different types of prohibited transaction exemptions.

Learning Objectives:

  • Define who is fiduciary under ERISA
  • List a fiduciary’s primary duties
  • Recognize the consequences associated with a fiduciary’s failure to discharge those duties
  • Discover who is a party in interest to the ERISA plan
  • Apply ERISA’s prohibited transactions to those parties in interest
  • Distinguish the different types of exemptions to the prohibited transactions
